Guardianship Petitions for Personal and Property Management Needs

When your loved one, because of some functional limitation, becomes unable to make proper decisions about themselves or their property, the Court has a procedure where you may be appointed to assist your loved one make important decisions.

A guardianship petition under Art 81 of the Mental Hygiene Law is brought when a person requires some form of assistance in meeting their personal and property management needs. In the event that a finding of incapacity is made by the court, or upon the consent of the subject party, the court will direct the least restrictive form of intervention which assists the incapacitated person in meeting their personal and property management needs but, at the same time, permits this person to exercise the independence and self-determination of which they are capable.
